Terms of Service
These Terms apply to BackPix ("the Service", "we", "us"). By creating an account you accept these Terms, our Privacy Policy and our Cookie Policy.
1. The Service
1.1 BackPix uses artificial intelligence to create images of you, and of people you add, in places you photograph.
1.2 Every image BackPix creates is AI-generated and is marked as such in its file. It is not a photograph of a real event.
1.3 AI results vary. We do not guarantee any particular result or likeness.
2. Your account
2.1 You must be at least 18 years old to use BackPix.
2.2 One account per person. The information you give us must be accurate, and you are responsible for the use of your account.
2.3 You can delete your account at any time in Settings. Deleting it permanently removes your photos and any remaining credits.
3. Your responsibility
3.1 You are responsible for the photos you upload and for how you use and share the images you create.
3.2 You may only upload photos of yourself and of people who have agreed to it. You may add a minor only if you are their parent or legal guardian.
3.3 You must not use BackPix to create images that are:
- sexual, nude or sexually suggestive, or that sexualise a minor in any way;
- meant to harass, humiliate, defame or impersonate anyone;
- meant to deceive, such as fake news, evidence or documents;
- violent, hateful or otherwise illegal;
- infringing anyone's copyright, trademark, privacy or image rights.
3.4 You must not remove the AI-generated marking where the law requires it, use bots or scraping, get around limits or security, resell access to BackPix, or use its images to train other AI models.
3.5 We and our AI providers may refuse to create, or may remove, content that breaks these rules.
4. Content and ownership
4.1 Your photos remain yours. You allow us to store and process them only to provide the Service. We do not use them to train AI and we do not sell them.
4.2 You may use the images you create for personal and commercial purposes, within these Terms. We claim no ownership of them. Similar images may be created for other users.
4.3 BackPix, its software and its brand belong to us.
4.4 BackPix is not a storage service. Save the images you want to keep.
5. Credits and payments
5.1 Shots are paid for with credits. The number of credits a shot costs is shown before you take it.
5.2 New accounts may receive free credits, once per person. Free credits can only be used for Standard shots. We may change or end this offer, and remove free credits obtained through repeated accounts.
5.3 Credits are sold in one-off packs. They have no cash value, cannot be transferred and do not expire while your account exists.
5.4 Prices are shown before payment and include any applicable taxes. Payments are processed by Stripe. Link, a Stripe company, may act as the reseller of your purchase; in that case Link's terms apply to the payment.
5.5 We may change prices and the number of credits a shot costs. New prices apply to future purchases.
6. Refunds
6.1 Credits are delivered immediately. By buying them you ask for immediate delivery and accept that you lose the 14-day right of withdrawal once they are delivered.
6.2 If a shot fails and no image is delivered, its credits are returned to your balance automatically.
6.3 If you were charged twice, or paid and did not receive your credits, contact us and we will refund the duplicate or undelivered payment.
6.4 Apart from the cases above, purchases are not refundable. This does not affect your statutory rights as a consumer.
7. Changes to the Service
7.1 BackPix relies on third-party AI providers and may at times be unavailable or contain errors.
7.2 We may change or remove features of the Service. If we decide to close BackPix, we will tell you at least 30 days in advance so you can use your remaining credits.
8. Suspension
8.1 We may suspend or close an account that breaks these Terms or the law, or is used for fraud, and we will tell you why unless the law prevents it.
8.2 Credits bought with a payment that is reversed or fraudulent are removed. While a payment is disputed with your bank, the credits it bought may be paused.
9. Reporting content
9.1 To report illegal content, or an image of you made without your consent, email support@backpix.app with the subject "Report", saying what the content is, where you saw it and why you are reporting it. This address is also our point of contact under the EU Digital Services Act, in English or Italian.
10. Liability
10.1 We are not liable for how you or others use the images you create, for losses we could not reasonably foresee, or for events outside our control.
10.2 Our total liability to you is limited to the amount you paid us in the 12 months before the claim.
10.3 Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
10.4 If you use BackPix for your business, you will compensate us for claims by others that arise from your breach of these Terms.
11. Changes to these Terms
11.1 We may update these Terms. If a change is significant, we will tell you in the app or by email before it takes effect.
12. Governing law
12.1 These Terms are governed by Italian law.
12.2 If you are a consumer, you keep the protection of the mandatory law of your country of residence and may bring a claim in the courts where you live. Otherwise, the courts of Milan, Italy, have exclusive jurisdiction.
13. General
13.1 If any part of these Terms is invalid, the rest remains in effect.
13.2 We may transfer these Terms to a company that takes over BackPix, without reducing your rights under them.
